The penalty for possession of one ounce or less of marijuana is a misdemeanor and is punishable by up to one year in prison and a fine of up to $1,000. The court may defer the proceedings and grant probation for no less than one year. Upon granting probation, the court may require drug treatment. If the terms of the probation are fulfilled, the court can discharge and dismiss the proceedings. Any conviction causes driver's license suspension for 6 months.
Any conviction causes commercial driver's license suspension for 1 year.

 

Possession of Marijuana in Arkansas: Code Section 5-64-401

5-64-401 (c) POSSESSION OF COUNTERFEIT OR CONTROLLED SUBSTANCE.

(1) It is unlawful for any person to possess a controlled substance or counterfeit substance unless the controlled substance or counterfeit substance was obtained:

(A) Directly from or pursuant to a valid prescription or an order of a practitioner while acting in the course of his or her professional practice; or (B) As otherwise authorized by this chapter.

(2) Any person who violates this subsection with respect to:

B) Any other controlled substance, first offense, is guilty of a Class A misdemeanor;

NOTE: Arkansas Code 64-215. Substances in Schedule VI [includes] (1) Marijuana.
