Possession of any amount of marijuana is a misdemeanor, punishable by up to six months in jail and a fine of $1,150. If the possession or sale of marijuana occurs within 1000 feet of a school the penalty can be up to 15 years in prison and a fine of up to $250,000, and if it occurs within 300 feet of a church, park or recreation area the penalty can be up to 15 years in prison and a fine of up to $250,000.

 

Possession of Marijuana in Delaware:

 

§ 4753. Prohibited acts C; penalties.

It is unlawful for any person knowingly or intentionally to possess, use or consume a controlled substance or a counterfeit substance which is a narcotic drug unless the substance was obtained directly from, or pursuant to, a valid prescription or order of a practitioner while acting in the course of the practitioner's professional practice or except as otherwise authorized by this chapter. Any person who violates this section shall be guilty of a class A misdemeanor.
