Marijuana Possession & Personal Use Penalties & Punishments in the State of South Carolina

Possession of one ounce or less is punishable by up to 30 days in jail and a fine of $100 - $200 for a first offense. For subsequent offenses the penalties increase to up to a year in jail and a fine of $200 - $1,000. Convictions for a first offense are eligible for conditional discharges. Possession of greater than one ounce is considered evidence of intent to sell and is punished as such.

 

Possession of Marijuana in South Carolina:

Title 44 - Health: CHAPTER 53.POISONS, DRUGS AND OTHER CONTROLLED SUBSTANCES

SECTION 44-53-370. Prohibited acts A; penalties.

(c) It shall be unlawful for any person knowingly or intentionally to possess a controlled substance unless the substance was obtained directly from, or pursuant to a valid prescription or order of, a practitioner while acting in the course of his professional practice, or except as otherwise authorized by this article.

(d) A person who violates subsection (c) with respect to:

(4) ... A person who violates this subsection with respect to twenty- eight grams or one ounce or less of marijuana or ten grams or less of hashish is guilty of a misdemeanor and, upon conviction, must be imprisoned not more than thirty days or fined not less than one hundred dollars nor more than two hundred dollars.
